Terms of Service & licence Agreement

1. Acceptance of Terms

By accessing and using our poker charts software ("the Software"), you agree to be bound by these Terms of Service and licence Agreement ("Agreement"). If you do not agree to these terms, you must not use the Software.

2. licence Grant

Subject to your compliance with these terms, WizardGotIt grants you a limited, non-exclusive, non-transferable, revocable licence to use the Software for your personal, non-commercial poker strategy study and improvement purposes only.

3. Restrictions on Use

You agree not to:

  1. Distribute, sublicence, rent, lease, sell, or otherwise transfer the Software to any third party.
  2. Modify, reverse engineer, decompile, or disassemble the Software, or attempt to derive the source code of the Software.
  3. Use the Software for any illegal or unauthorized purpose, or in any way that violates these terms or any applicable laws or regulations.
  4. Use the Software in a manner that could damage, disable, overburden, or impair our servers or networks.
  5. Circumvent, disable or otherwise interfere with security-related features of the Software or with features that prevent or restrict use or copying of any content or that enforce limitations on use of the Software.

4. Free Upgrades

As a licencee, you are entitled to receive free upgrades to newer versions of the same Software program. This includes bug fixes, performance improvements, and feature enhancements for the specific Software you purchased. This does not include upgrades to entirely new or separate software programs we may offer.

5. Disclaimer of Warranties

The software is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. WizardGotIt does not warrant that the software will be uninterrupted or error-free, that defects will be corrected, or that the software is free of viruses or other harmful components.

**Specifically, WizardGotIt makes no warranty or representation that the use of the software is permitted or compliant with the terms of service of any online poker platform, including but not limited to PokerStars, GGPoker, and CoinPoker. It is your sole responsibility to ensure that your use of the software complies with the terms of service of any poker platform you use. WizardGotIt shall not be liable for any consequences, including account suspension or bans, resulting from your use of the software on any poker platform.**

5.1 Anti-Detection Features and Third-Party Platform Compliance

The Software includes optional anti-detection features that mask its presence in the Windows Task Manager by using randomized process names. These features:

  1. Are provided solely as an optional privacy enhancement mechanism;
  2. Are designed to prevent unauthorized monitoring by third-party applications;
  3. May be flagged by antivirus software as suspicious behavior;
  4. May violate the Terms of Service of certain online poker platforms.

YOU ACKNOWLEDGE AND AGREE THAT:

  1. Your use of these anti-detection features is entirely at your own risk;
  2. WizardGotIt provides no warranty or guarantee that the use of these features will prevent detection by any third-party platform;
  3. WizardGotIt makes no representations about the legality of using these features with any specific poker platform;
  4. WizardGotIt shall not be liable for any consequences resulting from your use of these features, including but not limited to: account suspensions, bans, confiscation of funds, legal action, or any other adverse action taken by poker platforms against you;
  5. Certain jurisdictions may have laws restricting software that masks its identity - you are solely responsible for complying with all applicable laws in your jurisdiction;
  6. The decision to use the anti-detection features constitutes your agreement to assume all legal and financial risks associated with such use.

By activating the anti-detection features, you represent that you have read, understood, and agree to all terms in this section.

6. No Refunds Policy

All sales are final for the Software licences. Given the digital and instantly deliverable nature of licence keys, no refunds are offered after a licence key has been issued and is available for activation.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall WizardGotIt be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, good-will, or other intangible losses, resulting from (A) your access to or use of or inability to access or use the software; (B) any conduct or content of any third party on the software; (C) any content obtained from the software; or (D) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not WizardGotIt has been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom.

9. Entire Agreement

This Agreement constitutes the entire agreement between you and WizardGotIt concerning the Software and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and WizardGotIt with respect to the Software.

10. Changes to Terms

WizardGotIt reserves the right to modify or revise this Agreement at any time. We will notify you of any significant changes by posting the updated Agreement on our website. Your continued use of the Software after the posting of any modified Agreement constitutes your acceptance of such changes.

11. Data Collection

When activated, this software collects minimal, anonymized data for licence verification and fraud prevention purposes, including activation time and licence identifiers. This data collection occurs only once during the initial activation process. This data is used solely to verify valid licences and prevent unauthorized use. We do not collect personal information beyond what is necessary for these purposes, and all collected data is handled in accordance with applicable privacy laws.

12. Security Software Compatibility

Due to the nature of the Enhanced Privacy features that mask the software's presence in Task Manager, certain security software including Windows Defender and commercial antivirus products may flag the software as suspicious. This is a false positive detection caused by the privacy-enhancing functionality of our software. We provide detailed instructions in our documentation on how to recover the software from quarantine and create appropriate security exceptions. By using this software, you acknowledge that you may need to configure your security software to allow the operation of the Software.
